What You Declared Is What You Are Held To
There is a sentence in DAO 2016-08 that almost nobody reads out loud. It sits among the prohibitions, and it says that no establishment shall be operated at capacities beyond the limits required by law and stipulated in the Wastewater Discharge Permit.
Read that slowly. The permit is not a receipt for a plant you built. It is a ceiling. And the number that sets the ceiling did not come from the regulator. It came from you, or from whoever filled in your application, on a day when the building was not yet full and nobody had measured anything.
Most of the trouble we get called into starts there — not at the blower, not at the bacteria, but at a line on a form that was written years before anyone had a reason to doubt it.
The number is almost always an estimate, and usually ours
We ask every client for an influent laboratory result before we design. Almost nobody has one. We went back through our own project folders recently and counted: out of eighty-four wastewater projects, twelve had any laboratory result on file at all, and not one had a result labelled influent. Around six projects in seven came to us with nothing to design against but a building description and a headcount.
So we assume. We would rather not, but the alternative is not designing. And an assumption has to be made safely, which in this business means made bigger. If we are told the BOD is 300 mg/L and we have no sample to check it against, we do not design for 300. We design for something above it, because the cost of being under is a plant that never passes and the cost of being over is steel. The client pays for that uncertainty in tank volume, and they pay for it whether or not they ever see the arithmetic behind it. More samples means a tighter design and a lower price. That is the whole argument for testing, and it is a commercial argument, not a regulatory one.
Then that assumed number, or something derived from it, goes onto a permit application. And from that morning onwards it is not an estimate any more. It is a limit you agreed to.
The stream nobody counted
We were asked to review a design for a facility that had declared its wastewater as domestic. Domestic sewage is a well-behaved thing to design for. You know roughly what is in it, the biology is forgiving, and the tanks are not large.
Walking the site, we found a vehicle wash bay tied into the same line. Nobody had hidden it. It simply had not occurred to anyone that washing trucks produced wastewater in the regulatory sense — it was housekeeping, it was water on concrete, it went into a drain. The samples we eventually saw came back around 1,500 mg/L of suspended solids arriving at a plant that had been sized for sewage. Grit, road film, oil, and a load that turned up in a slug for two hours in the morning and then stopped.
That plant was not failing because it was badly built. It was failing because it was treating a wastewater nobody had told it about. The declared flow was honest; the declared composition was not, and no one had lied. They had just counted the toilets and forgotten the hose. Different industries put very different things down the same-looking drain, which is why we keep a breakdown of the parameters that actually matter by industry rather than treating every building as sewage until proven otherwise.
The time we created the problem ourselves
I would rather not tell this one, but it is the clearest example I have, and it was ours.
Early on, at a food processing plant, we combined the domestic wastewater from the offices and comfort rooms with the process wastewater from production into a single treatment line. It looked efficient. One plant, one set of pumps, one operator.
What it actually did was drag the entire flow under the stricter set of parameters. Two streams that could have been declared and handled separately became one stream that had to meet the tighter number for all of it, forever, at full volume. We also had the technology wrong at the start — a grease interceptor where the emulsified fats needed dissolved air flotation — and the plant only settled down after we retrofitted FBBR-style fixed-film media into the aeration tank. I have written elsewhere about what that job cost us. But the design decision that made everything else harder was made in an afternoon, on paper, before a single pipe was laid.
We do not combine streams now unless the arithmetic says combining is genuinely better, and we work that arithmetic out before anything is declared rather than after.
Which water you discharge to is our job to establish, not yours
The other half of the ceiling is the receiving water. The limits you are held to depend entirely on the classification of the body your outfall reaches, and those classifications are not the same everywhere and do not stay the same forever.
We found a line on one of our own quotations once that read, in effect, that determining the receiving water classification was the client's action item, to be sorted out with the regional office. That line should never have been there. Establishing the receiving water and its classification is treatment engineering and regulatory work. It is ours. Where it needs written confirmation, we prepare and file it, at our cost, and we state the answer in the quotation so the client can see what their limits will be before they sign anything.
Doing that properly means walking the outfall rather than reading a map. We have followed a discharge line expecting a creek and found it ending in a storm drain. We have been shown a plan that put the outfall one place and found it somewhere else entirely. Until someone has walked it, the class is a guess, and every number downstream of it — the BOD, the ammonia, the phosphate, the coliform you will be measured against — is a guess too.
Ammonia is usually where a wrong guess shows up first. Between one class and the next it moves enough that a plant either has to nitrify properly or does not, and that is a question of sludge age, tank volume and air, none of which can be added cheaply once the concrete is poured. The organisms that do it are slow and particular, and no amount of good operation compensates for a tank that was never big enough to keep them.
What we do before anything gets declared
We count streams first — every one of them. Toilets, kitchen, laundry, wash bay, canteen grease line, cooling blowdown, floor washings, the pipe from the generator room that somebody added in 2019. We ask what happens when the second tower opens, because a permit written against today's occupancy is a permit that expires quietly the day the building fills up.
We ask for several grabs taken across a real operating day, composited into one bottle, rather than one sample taken at ten in the morning when nothing much is happening. We rarely get it. When we do, the design gets smaller and the price gets lower, and we say so.
And we put the assumption in writing. If we designed against an assumed loading, the client should be able to read what we assumed and see what happens if reality turns out different. Our sizing and cost estimator exists partly for that reason — so an owner can move the flow and the loading themselves and watch what it does to the tank and the number, before anyone commits to a figure on a form.
What travels and what does not
None of this is a procedure you can lift and apply. Every site is different. A hotel in Mactan and a poultry operation an hour inland can declare identical daily volumes and have nothing else in common. The building we walked with the wash bay would have been perfectly fine if the wash bay had gone to its own small pretreatment, and the food plant would have been fine if we had kept two lines. What we can say is that in the jobs that have come to us in trouble, the failure was more often a declaration than a machine — a stream not counted, an occupancy that grew, a receiving water nobody had actually looked at.
So we count first now, and we assume out loud. It has worked for us repeatedly. Whether it maps onto your site is something neither of us can know from a blog post, which is why we would rather look at the drawings than guess.
